EME Services Ltd is registered as a private limited company in UK with company registration number 03805125 and registered address: EME Services Ltd, 220B Higher Road, Urmston, Manchester, M41 9BH. EME Services Ltd is VAT registered.

The term “EME Services Ltd” or “us” or “we” refers to the owner of the website. The term “you” refers to the user or viewer of our website.

Definitions

In these conditions of sale all references to "the Seller" are to EME Services Ltd and all reference to "the Buyer" are to the person, firm, company or by whom the order is given. All references to "the Goods" are to any item(s) supplied by the Seller to the Buyer.

Quotations

Any estimate or quotations shall comprise an invitation to treat and will remain open for a period of thirty days provided that the company has not previously withdrawn it.

Specifications

Every effort is made to ensure that the catalogue descriptions and illustrations are clear and accurate. All colours and sizes are approximate. The reproduction of colours is as accurate as photographic and printing processes will allow. Due to our policy of continual improvement some products may vary from those described. The company reserves the right to amend the specification, construction and/or design without prior notice.

Prices

All prices are subject to alteration without prior notice. VAT is charged at the current rate unless a VAT exemption certificate is supplied with order.

Payment Terms

Unless there is evidence in writing to the contrary payment shall be nett 30 days from the date of invoice. For new account customers payment by Pro-forma invoice or pre-payment may be required.

Deliveries

Orders placed before midday Monday to Friday will under normal circumstances be despatched the same day, subject to availability. Normal delivery is within 3-4 working days from receipt of order. We shall use reasonable endeavours (but do not guarantee) to deliver the products within 3-4 working days. Stated delivery times are no more than an estimate on the part of EME Services and shall not be binding upon EME Services, which shall not be liable for any costs or damage caused by reason of any delay in delivery. Carriage Charges

England, Wales and Scotland (excluding Highland and Islands):

• Web Order subtotal less than £150 (excl. VAT) - Postage and packaging £10.00 (excluding VAT).

• Web Order subtotal £150 and over (excl. VAT) - Postage and packaging is free* (exclusions apply).

• Email, Purchase Order and Telephone Orders - Postage and packaging is £15.00 +VAT (exclusions apply).

A `Next Day Guaranteed` delivery service is available for some items and prices for this service can be advised upon request.

* Please note that: Exclusions apply to `free delivery` offers. All oversized, heavy or bulky items, Couches, Gym & Exercise Equipment, Trolleys, Furniture etc., will be subject to additional carriage and handling charges and may require an extended delivery lead time. We regret we are unable to accept orders online for heavy items such as Couches, Exercise equipment etc. This is due to carriage charges. The prices are available, however should you wish to order this product, then you will need to contact our Sales Dept on 0161 748 5660. EME Services shall endeavour to inform you of any such charges and/or extended delivery times when you place your order, but shall not be deemed liable for any cost or damage caused by late or non-delivery of the Products.

Any delay in delivery of the Products shall not give you a right to reject the Products of cancel your order. EME Services reserves the right to deliver the Products in instalments.

Order Cancellation

All cancellation of orders must be in writing with our prior agreement. We are unable to accept cancellation of specially ordered or non-stock items.

Return Of Goods

All return for credit must be previously agreed in writing. Please contact our customer service department which will advise you in the correct procedures for all return items. A restocking charge of 20% of the value of the goods may be charged. It will be customers responsibility to return the goods at their expense within 10 working days from the invoice date. All returned goods must be in the original packaging, clean and unused.

Loss Or Damage

Any loss, damage or shortage must be notified within 3 working days or confirmed in writing within 7 days. Claims outside these times will not be accepted.

Interest Charges

The company reserves the right to charge interest on all overdue payments and outstanding balances at the rate of 5% per month.

Limits Of Contract And Variation Of Prices

(i) A quotation includes only such goods as are specified therein.

(ii) The Contract is personal to the Buyer who may not assign it without the Seller's written consent.

(iii) The Seller reserves the right to amend the Contract price at any time up to delivery to take account of any variations in the cost of transport, the prices charged by the Seller's suppliers, changes in the value of any relevant currency, new or increased taxes duties or other imposts or variations arising from new legislation or regulations.

Description

The company is continually seeking to improve the quality and value of its goods and services. Whilst every care is taken to ensure illustration and descriptions within the catalogue are accurate and informative, we do reserve the right to change specifications and improve products. In the event of substitute products not being acceptable, we will issue a full credit, provided the goods in question are returned in a new, resalable condition and in line with our Return of Goods Policy, outlined.

Warranty

The Company warrants that the Goods shall at the time of delivery correspond to the specifications published by the Company when used for purposes for which goods of that are ordinarily used. In the absence of any such published specifications applicable to the Goods, the Company warrants that the Goods shall at the time of delivery be of merchantable quality. If any Goods do not conform to that warranty the Company will as its option i) replace the Goods found not to conform to the warranty, ii) bring the Goods into conformity with the published specifications of the Company or as the case may be) merchantable quality, or iii) take back the Goods found not to conform to the warranty and refund the appropriate part of the purchase price. All claims must be made in writing to the customer service department accompanied by proof of purchase and details/nature of defect.

Reservation Of Title

Title of goods does not pass until full invoice value has been paid.
